Agreement to Terms

By accessing or using the Premium Air Leads website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Services

Premium Air Leads provides HVAC marketing services including but not limited to website design, search engine optimization, AI-powered assistants, pay-per-click advertising, and lead generation. Specific service deliverables, timelines, and pricing are outlined in individual client agreements executed separately from these terms.

Performance Guarantee

The "Top 3 in 90 Days or You Don't Pay" guarantee is subject to the following conditions:

• Applies only to qualified businesses that meet eligibility requirements as determined during the onboarding process
• Eligibility is assessed based on market conditions, service area, competition level, and business standing
• Rankings refer to Google local search results for agreed-upon keywords in the client's service area
• Premium Air Leads is not affiliated with Google LLC and does not control search engine algorithms
• Specific results cannot be guaranteed as search rankings are influenced by many external factors

Client Responsibilities

Clients engaging our services agree to:

• Provide accurate and complete business information
• Grant necessary access to business listings, website hosting, and other accounts as required
• Respond to communications and approval requests in a timely manner
• Not engage in practices that violate search engine guidelines or applicable laws

Intellectual Property

All content on the Premium Air Leads website, including text, graphics, logos, icons, images, and design elements, is the property of Premium Air Leads and is protected by applicable intellectual property laws. Websites and marketing materials created for clients become the client's property upon full payment, unless otherwise specified in the client agreement.

Payment Terms

Payment terms are outlined in individual client agreements. Unless otherwise specified, invoices are due upon receipt. Premium Air Leads reserves the right to suspend services for accounts with outstanding balances exceeding 30 days past due.

Limitation of Liability

To the fullest extent permitted by law, Premium Air Leads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from the use of our services or website. Our total liability for any claim shall not exceed the total amount paid by the client for the specific services giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Premium Air Leads, its officers, employees, and agents from any claims, damages, losses, or expenses arising out of your use of our services, your violation of these terms, or your violation of any rights of a third party.

Termination

Either party may terminate services in accordance with the terms outlined in the individual client agreement. Premium Air Leads reserves the right to terminate or suspend access to our website or services at any time, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users or our business.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the state in which Premium Air Leads operates, without regard to conflict of law provisions.

Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.
